POWER-PED Warranty

Electric bicycle riding tips.
1. IMPORTANT: This product is classified as and Electric Power Assisted
bicycle. The bicycle is designed to be used as a power assisted bicycle. Use
of the bike in the correct way will provide an excellent riding experience.
This means pedaling is required to ensure maximum economy and
performance figures are achieved. It is not a motor cycle. Customers using
throttle only and no pedal assistance will VOID warranties and be
disappointed with the performance of their product. Our products are
rigorously tested to the highest possible stress levels. This means we can
easily identify when electronic components have been pushed beyond
reasonable usage limits.
2. Throttle function is designed to assist the rider from a stationary start. Use
throttle and pedal power together when starting off. Using throttle only to
start off is not recommended as this reduces battery life.
3. Use the pedals to assist the bike and ensure maximum range is achieved. We
strongly recommend pedaling and motor power together.
4. Specified distances and speed will only be achieved by pedal assisting the
motor.
5. Set seat height so heel of foot touches the pedal with the leg straight.
Consult your dealer or EVS for advice on seat position.
6. Charging at both ends of a regular trip is a good idea, e.g. take charger with
you or have a second charger at the other end of your trip.
7. The more you pedal the further you can travel per charge and better the bike
performs.
8. These bicycles are designed for smooth surface riding only. Riding over
gutters, footpath road crossings or rough terrain may result in damage or
injury to the rider.
9. No jumping stunt work or additional weight loading than specified. (90kg
inc Rider)
10. Water ingress and resultant damage is not covered under warranty.

Rear Wheel Removal-Disc Brake Models
• Turn the bicycle upside down and carefully support on handlebars and seat.
• Ensure the gear selector is in 7th gear and the chain is on the 7th sprocket
gear.
• The rear wheel has a special automotive 8 pin water resistant plug located
on the rear LH stay of the bike.
• There is a sheeth cover over the plug to protect it.
• Remove the zip ties and disconnect the plug.
• Loosen the 18mm rear Nuts on both sides of the wheel
• Lift wheel and remove it from bicycle.

Limited WARRANTY:
• Motor, Controller and Throttle – 12 months
• Batteries – 6 months pro-rata.
• Bicycle components (non-electrical, excluding tyres, tubes, brakes) 12
months.
• Warranty Card must be completed and returned to Electric Vehicles Pty
Ltd along with proof of purchase from and Authorized EVS/Power Ped
dealer.
• Warranty will subject to the bicycle being serviced according to the service
schedule provided. Service schedule detailed in this manual must be
performed by an authorized EVS dealer.
• Warranty covers parts only from EVS. Shipping and labor is not included
in the warranty.
• Warranty is covered for ORIGINAL purchaser only from the original date
of purchase. Dealer stock that has not been maintained correctly will not
be covered under warranty.
• Exceeding load limits as described or misuse of this bicycle will void
warranty.
• Use of bicycle under excessive loads and failure to pedal when using
throttle only mode to assist the bicycle will void Warranty.
• This warranty gives you specific rights in addition to other rights you may
have. These rights may vary from state to state. Which the consumer has
under the trade practice act and other state and territory laws.

Exclusions
The warranty, or any implied warranty does not cover normal wear and tare and
all warranties are void if the bicycle is used for other than normal activities or
weight limits are exceeded. Occasionally bicycles are involved in accidents.
Repairs or replacements required where there is evidence that such conditions
have contributed to a component failure, will not be covered under warranty.
Helmets
EVS recommend you use an Australian Standards approved helmet at all times
when riding any bicycle product.
Claims under this warranty should be made to your authorized Electric Vehicles
dealer with dated proof of purchase, and said dealer will determine if the
component(s) is defective. Any defective part will be replaced free of charge.
Installation labor is not included in this warranty. This warranty is extended to the
original owner only and does not cover any defect, malfunction or failure which
does not conform to the limited warranty.

NOPE Warranty

The following Terms of Sale / Warranty will apply to the purchase of any products sold by Good Concepts Pty Ltd (hereafter referred to as GOOD CONCEPTS). 

 

1. Placement of Orders. An order has been placed once Good Concepts has received confirmation by fax or email from the customer. No binding contract shall exist until the order has been accepted by GOOD CONCEPTS. GOOD CONCEPTS appreciates customer interest in its products and will endeavor to make its products available for purchase at all times. From time to time, however, heavy demand, limited editions or other factors beyond the control of GOOD CONCEPTS may render its products temporarily or permanently unavailable. GOOD CONCEPTS may at its absolute discretion decline to supply its products where (a) the products are unavailable for any reason; (b) an order placed has not been received by GOOD CONCEPTS for any reason; or (c) full payment for the product has not been received by GOOD CONCEPTS from the customer at the time of dispatch.

Prices for GOOD Concept’s products are the amounts specified in Australian dollars on this document as at the date of purchase (hereinafter referred to as the “Prices”). GOOD CONCEPTS shall honor the price quoted on any confirmed order. In the absence of a confirmed order however, GOOD CONCEPTS reserves the right to alter the Prices without notice. The Prices do not include insurance. The amount of Goods and Services Tax included in the Prices are specified on the form, as required by law.

2. Delivery. This section applies to all deliveries, including delivery to any GOOD CONCEPTS premises (including premises of GOOD Concept’s agents), where pickup from the GOOD CONCEPTS premises is arranged. GOOD CONCEPTS will quote a delivery date when an order is placed, and will endeavor to achieve the quoted delivery time, subject to availability and time of ordering. For deliveries to GOOD CONCEPTS premises, you will receive an e-mail or telephone call notifying you of the time of arrival of your order at GOOD Concept’s premises. GOOD CONCEPTS will endeavor to deliver in accordance with the quoted time frames, however GOOD CONCEPTS is unable to guarantee specific delivery dates for orders, and delivery later than these estimated times will not constitute a valid reason for returns or refunds for Products. In particular, normal time frames may be exceeded where remote locations are involved. GOOD CONCEPTS will not, to the extent permitted by law, be liable for any loss or damage arising out of or in connection with goods delayed, damaged or lost in transit.

3. Risk and Title. Title, and all associated risks, in the products will pass to the customer immediately when all amounts due and payable have been paid in full.

4. Cancellation of Orders, Refunds and Exchanges. Requests for cancellation will be considered by GOOD CONCEPTS on a case-by-case basis and GOOD CONCEPTS will exercise its sole discretion in determining whether an order validly placed may be cancelled. GOOD CONCEPTS reserves the right to charge a 10% cancellation fee to cover administrative costs for any orders cancelled prior to the dispatch of your order. No cancellations of orders will be accepted after dispatch of the order. When the products delivered are faulty or do not fit the description on the order form, the buyer shall have the choice of refund or exchange. No refunds or exchange will be granted in any other circumstance.

5. Limitation of Liability. The customer is solely responsible for their selection of GOOD CONCEPTS products and the use and application of GOOD CONCEPTS products purchased from GOOD CONCEPTS. GOOD CONCEPTS products are delivered with written instructions as to appropriate and safe use and should be used in accordance with the Instructions at all times. Failure to follow the Instructions indemnifies GOOD CONCEPTS from liability arising from use of the product. Whilst GOOD CONCEPTS manufactures in accordance with specific manufacturing standards, it is the buyer’s responsibility to ensure that the goods comply with the requirements of the applicable local laws and conditions, such as, but not limited to, for individual parks and council and Crown lands. Except in relation to the liability which cannot be excluded by law, in no event will GOOD CONCEPTS be liable or responsible to you for any loss or damage of any kind whatsoever (including but not limited to consequential loss or damage) which may be suffered or incurred or which may arise directly or indirectly out of the selection, use or application of GOOD CONCEPTS products or the supply, delay or failure to supply products by GOOD CONCEPTS. Where legislation implies into these Terms of Sale any condition or warranty which cannot be excluded by law, GOOD Concept’s liability for breach of any such condition or warranty will be limited at GOOD Concept’s sole discretion to the repair or replacement of the products or the cost of having the products repaired or replaced. The buyer indemnifies GOOD CONCEPTS, as much as allowed by the law, against all claims made in respect of any injury or death of persons or damage to any third party including property arising from the possession, hire or use of the products, whether lawful or unlawful. The buyer indemnifies GOOD CONCEPTS against any liabilities or claims arising from breach of these Terms of Sale, including use of the products for a purpose other than that which it is intended for. The buyer indemnifies GOOD CONCEPTS from any liability arising from the buyer (a) making any modification to the vehicle in any manner including but not limited to the vehicle livery; or (b) making any adjustment to the vehicle that would deem the vehicle unfit for safe use; or (c) failing to ensure that the required maintenance is carried out including but not limited to battery charging.

6. Limited Warranty. GOOD CONCEPTS shall supply the vehicle in good working order. However, the warranty provided by GOOD CONCEPTS is limited to the terms set out below. Failure to follow the Instructions will void the Product Warranty, and it is the buyer’s responsibility to ensure that the Instructions are followed. GOOD CONCEPTS shall offer a twelve (12) month repair or replacement warranty on its range of vehicles, chargers and batteries. Where the sales receipt specifies, the period of warranty may be altered and will only apply for the specified period. The warranty shall be activated from the day that the vehicle, charger or battery passes into the customer’s ownership. If the customer wishes to make a warranty claim, they shall phone or write to GOOD CONCEPTS (or the authorized agent from which the vehicle was purchased) and arrange to send the product, at their own expense, to GOOD CONCEPTS (or the authorized agent from which the vehicle was purchased) for inspection. Included with the product when it is sent to GOOD CONCEPTS/the agent shall be:

• A copy of their original sales receipt/tax invoice;

• A copy of an invoice verifying any freight or courier costs incurred by the customer to transport the product to GOOD CONCEPTS/the agent;

• A clear written description of the defect that is the subject of the warranty claim;

• Full telephone, email and postal contact details for the customer. The following shall be covered by warranty:

• The cost, to a maximum value of $500.00, of the replacement or repair of any faulty or defective component(s) of the product that is found to have been caused through no action of the customer that is contrary to the operating and care instructions provided with the product;

Where the claimed fault is found to be valid under the terms of warranty, the cost of shipping the product to (by means of credit or reimbursement of the cost incurred by the customer, to be verified by a copy of an invoice) and from GOOD CONCEPTS, to a maximum value of $30.00 each way. The following shall not be covered by warranty:

• Any warranty claim on any vehicle that has been modified in any manner that affects its operation, including but not limited to the vehicle livery; • Any warranty claim on any vehicle where the customer has made any adjustment to the vehicle that would deem the vehicle unfit for safe use;

• Any defect or failure that is found to be the result of a lack of proper care or maintenance (including but not limited to proper battery charging);

• Any defect or failure that is found to be the result of operator abuse of the product (abuse being defined as any action that ignores or is contrary to any of the operating and care instructions provided with the product, including the User’s Manual); • Any defect or failure that occurs outside of the warranty period. GOOD CONCEPTS (or the authorized agent) shall, within seven (7) days of receiving the product, carry out a warranty inspection of the product, the results of which shall be contained in a written report that shall be sent to the customer by either post or email, as nominated by the customer. This report shall set out:

• What defects or faults were found under inspection carried out in accordance with the customer’s description of the alleged fault;

• The findings as to whether the defect or fault shall be covered by warranty according to the above terms;

• If appropriate, a quotation for the repair or replacement of the faulty part, including any credits or reimbursements as per the terms above, and for shipping the repaired or replacement product back to the customer. The customer shall be given seven (7) days to respond to this quotation, in the absence of which the quotation shall be considered to have been declined, and the product shall be returned to the customer with an invoice for any outstanding fees or charges. If the customer approves the quotation provided, the quoted amount must be prepaid before such repair or replacement is carried out. 7. No indemnification. Unless otherwise expressly provided in writing signed by both parties, GOOD CONCEPTS does not indemnify, nor does it hold the buyer harmless, against any liability, losses, damages and expenses relating to any claim whatsoever, including without limitation claims for personal injuries, death or property damage related to the products sold by GOOD CONCEPTS. 8. Limitation of Action. GOOD CONCEPTS shall not by any delay in enforcing its rights be deemed to have waived any of those rights and no waiver by GOOD CONCEPTS of any breach by the buyer shall be deemed to be a waiver of any continuing or recurring breach 9. Privacy. GOOD CONCEPTS is committed to protecting the privacy of your personal information. For further details, please refer to our Privacy Policy. 10. Governing Law. These Terms of Sale will be construed in accordance with and governed by the laws of Australia and each party agrees to submit to the non-exclusive jurisdiction of the courts of Australia.
